Introduction

The terms of use defined below explain what you can do with the materials that are available from AssistiveWare. By accessing AssistiveWare's websites and/or downloading, accessing or using the content and/or materials available from AssistiveWare's website in any manner, you agree to be bound by the terms of this agreement.

The terms are designed to allow you to make optimal use of the materials, and at the same time protect the quality and avoid any misuse of AssistiveWare's materials.

In summary, the terms of use allow you to use AssistiveWare's websites and free materials for yourself, with your colleagues, and with any client, child or student under your supervision. The terms prohibit you from distributing the material to others, in both its original form, or with alterations, modifications or translations. Instead, we encourage you to let others know where they can get the latest version of the material themselves.

You are allowed to show the material to others, or quote parts of the material in your own creations, as long as you mention the original source. If you want to use screenshots from AssistiveWare's websites or the free materials in a publication, you must always obtain prior approval from AssistiveWare. AssistiveWare wants to make sure you are using up to date and high-quality material.

If you disagree with these terms and conditions or any part of these terms and conditions, you must not use the materials that are available from AssistiveWare. If you feel the terms of use limit you in effectively using the material please contact us at support@assistiveware.com.

Terms of Use

This TERMS OF USE ("Agreement") is a legal agreement between you (either an individual or an entity you represent or work for) and AssistiveWare BV, located at Laurierstraat 193 - 1016PL Amsterdam - the Netherlands. ("AssistiveWare").

Scope

This Agreement applies to and governs your use of and access to AssistiveWare's websites* and the use of any free material created by AssistiveWare, distributed via or displayed on these websites or by other means** (together called the "Material").

Acceptable Use

This Agreement grants you the use of the Material for personal purposes, and for personal use of any user (such as child, client or student) under your direct guidance or supervision.

You may show the material to others, share the material with your direct colleagues, or quote parts of the Material in your own creations, as long as you include a legible and noticeable reference to the source of the Material, when the Material is viewed, used, displayed, and presented.

You may embed AssistiveWare's videos in your creations linking to the online videos. You may only copy the video material (for offline usage) into your creations for one-time usage by you, personally.

Restrictions

You may not distribute, make available, assign or convey the Material without prior written permission from AssistiveWare. You may not sell, lease, or license the Material.

You may not distribute, lease, sell, make available, assign, license or convey any derivative work (such as, but not limited to, alteration, translation, reduction, expansion or inclusion) based on the Material.

You may not use images from the Material in printed or electronic publications or displays, other than as expressly permitted by this Agreement, without the prior written approval from AssistiveWare.

AssistiveWare reserves the right to change, modify, add, or remove portions of the Material anytime, with or without notice.

AssistiveWare reserves all rights not expressly granted in this Agreement.

Breaches of the Agreement

If you breach the terms in this Agreement in any way, AssistiveWare may take such action as AssistiveWare deems appropriate to deal with the breach, including suspending your access to the Material, prohibiting you from accessing the Material, blocking computers using your IP address from accessing the Material, contacting your internet service provider to request that they block your access to the Material and/or bringing court proceedings against you.

Severability

If any terms of this Agreement are found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render this Agreement unenforceable or invalid as a whole, and any such terms shall be deleted without affecting the remaining terms herein.

Other terms

This Agreement is worldwide, non-exclusive, non-transferable and non-licensable. Unauthorized use of the Material will result in immediate termination of this license.

No ownership or copyright in any Material shall pass to you by the issuance or acceptance of this Agreement. The Material is protected by laws of the United States and other jurisdictions, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws, including without limitation, applicable copyright, trade dress, patent, and/or trademark laws. All Material, including intellectual property rights therein and thereto, are the property of AssistiveWare or its subsidiaries or affiliated companies and/or third-party licensors. Copying, redistribution, use or publication by the user is strictly prohibited except as expressly allowed by other sections of this Agreement.

The introduction above is not part of the Agreement itself. No rights can be derived from the introduction text.

AssistiveWare may, at its sole discretion, make changes to this Agreement. The Agreement will be identified by its publication date and will be effective immediately upon being published. Your use of the Material after changes to the Agreement become effective constitutes your acceptance of such changes.

THE INFORMATION CONTAINED IN THE MATERIAL IS FOR GENERAL INFORMATION PURPOSES ONLY AND IS PROVIDED IN "GOOD FAITH" ON AN "AS IS" BASIS. ASSISTIVEWARE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE COMPLETENESS, ACCURACY, RELIABILITY, SUITABILITY OR AVAILABILITY WITH RESPECT TO THE MATERIAL FOR ANY PURPOSE. ANY RELIANCE YOU PLACE ON SUCH INFORMATION IS THEREFORE STRICTLY AT YOUR OWN RISK.

IN NO EVENT WILL ASSISTIVEWARE BE LIABLE FOR ANY LOSS OR DAMAGE, DIRECTLY, INDIRECTLY OR CONSEQUENTIALLY, ARISING OUT OF, OR IN CONNECTION WITH, THE USE OF THE MATERIAL, INCLUDING WITHOUT LIMITATION, ANY LOSS OR DAMAGE WHATSOEVER ARISING FROM LOSS OF DATA OR PROFITS

AssistiveWare does not, and will never, provide medical advice. The Material is by no means intended to be a substitute for professional medical advice, diagnosis, or treatment.

* AssistiveWare's websites are served from at least the following non-exhaustive list of domains: assistiveware.com. www.assistiveware.com, video.assistiveware.com, support.assistiveware.com, coreword.assistiveware.com.

** The Materials available from AssistiveWare's websites include without limitation documentations, instructions, presentations, blogs, lessons, or product descriptions. The Materials may be distributed without limitation as web pages, word/text documents, PDF documents, presentations, video and audio files in any format. AssistiveWare's Materials are usually marked with ©AssistiveWare. However, such marking is not required for the Material to be created and owned by AssistiveWare. AssistiveWare's Materials may be distributed, accessed, hosted, or served from AssistiveWare's websites, as well as third-party websites including without limitation AssistiveWare's YouTube and Vimeo channels.
